NCLAT to decide on Meta’s appeal aginst CCI’s ₹ 213.14 cr penalty on January 23

NCLAT has adjourned Meta’s appeal hearing regarding the Rs. 213.14 crore penalty imposed by the CCI for anti-competitive practices related to WhatsApp’s 2021 privacy policy. The case, represented by Kapil Sibal and Mukul Rohatgi for Meta, will be heard on January 23.

The National Company Law Appellate Tribunal (NCLAT) admits Meta‘s appeal filed against the Competition Commission of India (CCI) ₹ 213.14 cr penalty on Meta for alleged abuse of its dominant position related to WhatsApp’s 2021 privacy policy.

The appellate authority is set to decide on Meta’s stay on January 23.

In November 2024, CCI imposed the penalty on Meta. In its order, CCI directed Meta to “cease and desist” from such practices. Additionally, it required the company to implement certain behavioral remedies within a stipulated timeframe to resolve the competition issues.

Kapil Sibbal and Mukul Rohatgi represented Meta.

The matter was heard before the bench of Justice Ashok Bhushan, the Chairperson, and Justice Arun Baroka (Technical Member).
