Beshear signs new cannabis drink regulations into law

Senate Bill 202 outlines a new regulatory framework for cannabis-infused drinks in Kentucky.

FRANKFORT, Ky. — Kentucky Gov. Andy Beshear has signed a bill that enacts stricter regulations for cannabis-infused drinks in the state.

Senate Bill 202 passed the General Assembly with bipartisan support. It establishes a new “comprehensive regulatory framework” for the beverages, which are already legally being sold in Kentucky.

The law clarifies product labeling, defines agency oversight responsibilities, and institutes fee structures for cannabis-infused beverage licenses. It also directs the University of Kentucky to conduct further studies on the impact of cannabinoid beverages on public health and commerce. The study’s findings are due in 2026.

“This legislation ensures that as this emerging industry takes shape, Kentucky leads with a balanced approach that protects public health, supports reasonable business practices, and promotes transparency,” the bill’s sponsor, Sen. Julie Raque Adams (R-Louisville) said.

Kentucky’s Department of Alcoholic Beverage Control (ABC) will now regulate the industry, which was previously regulated by the Cabinet for Health and Family Services as hemp-based products.

The law also limits the milligrams of intoxicating cannabinoids per serving, while temporarily extending certain sales permissions while the regulation’s framework is finalized. 

“This is a fast-evolving area, and SB 202 positions Kentucky to approach it with clarity, caution, and a commitment to smart policy,” Adams added.
