Commission proposes change to waste shipment rules

The European Commission today (29 April) proposed a targeted and limited amendment to the Waste Shipment Regulation to continue allowing exports of mixed municipal waste for recovery to Switzerland, including for recycling or energy. 

Under current EU rules, as of 21 May, the export of mixed municipal waste for recovery to countries outside the European Economic Area (EEA) — including Switzerland — will be banned.

This would disrupt long-standing, sustainable waste management practices in border regions, particularly in Austria, France, Germany and Italy, where around 200,000 tonnes of such waste are sent to Switzerland each year. 

Many EU communities rely on nearby Swiss facilities for efficient waste treatment, in line with the EU’s principle that waste should be handled as close as possible to where it is produced.

A ban would force waste to be transported over longer distances within the EU, in some cases shifting transport from rail (a greener option) to road. This would increase greenhouse gas emissions, while offering little economic or environmental benefit. 

The Commission’s proposal provides a practical solution to avoid unnecessary burdens on local authorities and waste operators, while maintaining high environmental standards. The export of waste for landfilling or incineration without energy recovery will continue to be prohibited, as under current rules. 

This amendment supports the EU’s simplification agenda and circular economy goals, ensuring that waste management remains efficient and sustainable. 

Next steps

The European Parliament and the Council will now discuss the Commission proposal. 

Background

Since 1993, the EU has regulated the cross-border shipment of waste to ensure safe, transparent, and environmentally responsible management.  

A new EU Waste Shipment Regulation entered into force on 20 May 2024 to ensure the EU takes greater responsibility for its waste. The Regulation includes a ban on exporting mixed municipal waste for recovery to non-EEA countries from 21 May 2026.
