Effort to ban THC moving through Texas legislature

TEXAS (KXII) – A bill that would ban all forms of THC, the psychoactive compound found in cannabis, is making its way through the Texas legislature.

It’s a top priority for Lt. Governor Dan Patrick, who said he will even push for a special session to get it passed.

Senate Bill 3 would prohibit the retail sale of any cannabinoid in Texas – except CBD and CBG.

The bill would ban delta 8, delta 9, and all other forms of intoxicating THC.

“This business did not exist several years ago in Texas, until they found a loophole in the law,” said Lt. Governor Patrick.

Patrick said more than 8,000 smoke shops have popped up in Texas in recent years.

Since 2019, the republican- led legislature approved the sale of consumable hemp the legal limit to posses THC is 0.03%, anything higher is classified as marijuana.

“The lowest levels of concentration of THC are designed to where it shouldn’t mimic a high of marijuana, but again if you get something that is a higher concentration of THC it can act like any intoxicant,” said Sgt. Brandon Hughes with the Sherman Police Department.

Others say THC is a way for people to relax and alleviate pain. In 2015 governor Greg Abbott signed the Compassionate Use Act.

The bill is now in the Texas House State Affairs Committee.
