Maui Asphalt cited for numerous violations on Kauai

The Hawaii Department of Health issued a Notice of Violation and Order to Maui Asphalt X-IV, LLC (Maui Asphalt) on Monday for numerous violations at their asphalt batch plant in Waimea on Kauai.

According to a DOH news release, the company has been ordered to pay $33,000 and to take action to bring the company back into compliance with their National Pollutant Discharge Elimination System Notice for General Permit Coverage.

The NOVO will become final 20 days after being served unless a hearing request if file, according to the release.

“NPDES permits ensure that all organizations are held accountable for the proper disposal of pollutants,” said Kathleen Ho, the deputy director for the Environmental Health Administration, in the release. “It is everyone’s responsibility to help keep our waters clean.”

The DOH news release stated that it’s mandatory for the public, including business owners, government agencies and visitors, to comply with environmental laws protecting Hawaii, adding that violators who fail to comply with water pollution laws may be subject to penalties up to $60,000 per day, per violation.

The DOH Clean Water Branch keeps Hawaii’s waters fishable and swimmable for the public by prohibiting discharges that impair water quality. Failing to comply with environmental regulations can result in legal action by the state, federal partners and/or private citizens.
