LINCOLN, Neb. (KLKN) — Nebraskans for Medical Marijuana is criticizing Attorney General Mike Hilgers after Nebraska joined a federal lawsuit challenging the federal government’s effort to reclassify cannabis as a less harmful drug.

Nebraska, along with Indiana and Louisiana, recently asked a federal court to overturn the Trump Justice Department’s decision to move cannabis from a Schedule I to a Schedule III drug.

Crista Eggers, executive director of Nebraskans for Medical Marijuana, is accusing Hilgers of using taxpayer money to oppose the will of the voters.

“Voters should be furious,” Eggers said in a statement. “Mike Hilgers is using the money of the very people he is fighting. Nebraskans voted for medical cannabis, and now their Attorney General is making them pay for his attempt to stand in their way.”

Eggers also said that those who are against medical marijuana have relied on its Schedule I status to argue against legalization efforts.

“For years, opponents used federal Schedule I status as an excuse to deny that cannabis has medical value,” she said. “Now that President Trump and the DOJ are moving away from that outdated position, Hilgers is suing to keep that excuse alive.”

The three attorneys general, along with the anti-cannabis advocacy organization Smart Approaches to Marijuana, filed the petition in the D.C. Circuit last week.

Hilgers has not made a public comment about the lawsuit.
