AND WE NOW HAVE THE BODY CAMERA VIDEO SHOWING THE TENSE MOMENTS OUTSIDE AN AMAZON FACILITY. BIG NEWS WHEN IT HAPPENED. WLWT NEWS FIVE’S DANIELLE DINDAK WAS THERE FOR THE RELEASE OF ALL OF THE VIDEO. AND DANIELLE. LONG CONFRONTATION. YES, YOU’RE EXACTLY RIGHT, MIKE. AND FROM THE TIME THAT OFFICERS ARRIVED TO THE SCENE TO WHEN THOSE SHOTS WERE FIRED, WE’RE TALKING ABOUT APPROXIMATELY 15 MINUTES. NOW, THIS ACTUALLY ALL STARTED WITH A REPORT OF A STOLEN SEMI TRAILER. AND HERE THE MOMENTS AFTER OFFICERS ARRIVED. TAKE A LOOK. I BE DETAINED RIGHT NOW. ALL RIGHT. OKAY, WE’RE GONNA FIGURE THIS OUT. NO, WE GOT ONE RUNNING. THE MAN WHO POLICE KILLED WAS 35 YEAR OLD MICHAEL SIMPSON. THIS ALL STARTED WITH A REPORT OF A STOLEN SEMI TRAILER. GPS TRACKING LED POLICE TO INDUSTRIAL PARK. TO GIVE YOU SOME MORE CONTEXT INTO THAT CLIP. YOU JUST SAW, AN OFFICER WALKS UP TO SIMPSON, AND AT THE SAME TIME, ANOTHER OFFICER IS TRYING TO CUFF HIM, BUT SIMPSON TAKES OFF RUNNING AND PULLS OUT A GUN AND POINTS IT AT HIS OWN HEAD. THIS STARTS A LENGTHY STANDOFF. THROUGHOUT THE VIDEO, OFFICERS ARE TRYING TO CALM HIM DOWN AS SIMPSON REPEATEDLY SAYS HE’S NOT GOING BACK TO JAIL. EVENTUALLY, SIMPSON MAKES HIS WAY TO THE AMAZON FACILITY AND TRUCK LOADING AREA. AT ONE POINT, SIMPSON GOES TOWARDS THE OFFICERS WITH THE GUN IN HIS HAND. THAT’S WHEN TWO DEPUTIES FIRED OFF FOUR SHOTS. ALL FOUR OF THOSE SHOTS HITTING SIMPSON. THEY TRIED CPR. SIMPSON DIED AT THE HOSPITAL. PROSECUTOR ROB SANDERS WAS HANDED THIS INVESTIGATION AND DEEMED IT A JUSTIFIED SHOOTING. LAW ENFORCEMENT IS NOT REQUIRED TO WAIT UNTIL A GUN IS ACTUALLY POINTED AT THEM BEFORE THEY USE DEADLY WEAPON. THEY, LIKE ANYBODY ELSE IN THE COMMONWEALTH OF KENTUCKY, ARE ONLY REQUIRED TO BE IN REASONABLE FEAR THAT THEY ARE ABOUT TO SUFFER DEATH OR SERIOUS PHYSICAL INJURY. THE NOTION THAT LAW ENFORCEMENT MAY NOT FIRE UNTIL FIRED UPON IS SOMETHING THAT I THINK HAS BEEN GENERATED BY THE MEDIA OR SOCIAL MEDIA, THE INTERNET, SOMETHING LIKE THAT. BUT THAT’S NOT THE LAW IN KENTUCKY, AND THAT’S NOT THE WAY OFFICERS ARE TRAINED TO REACT. NOW, SANDERS DID GO ON TO SAY THAT SIMPSON DID SPEND SOME TIME IN JAIL ON DUI CHARGES, AND SANDERS ALSO DID MENTION THAT SIMPSON HAD PREVIOUSLY TALKED ABOUT COMMITTING SUICIDE BY COP. REPORTING LIVE TONIGHT IN KENT COUNTY. DANIELLE DINDAK WLWT NEWS FIVE. ALL RIGHT, DANI
Officers cleared in fatal shooting of armed man near Amazon facility in Florence
Two officers have been cleared of any wrongdoing after a fatal police shooting near an Amazon facility in Florence last month.Kenton County Commonwealth’s Attorney Rob Sanders said the two officers were justified in their use of deadly force.”This was just an unfortunate and tragic situation of a suspect attempting to commit suicide by cop,” Sanders said. The incident began just before 7 a.m. April 29 on Industrial Road with a report of a stolen tractor trailer, and ended with shots fired outside the Amazon facility. It all started when police said officers pulled a man over. They said when the man stopped, he was not compliant with commands, which resulted in a “physical altercation.”Witnesses said the man exited the vehicle with a gun and pointed it at his own head, leading officers to follow him as he walked toward the Amazon facility.Sanders said it was a total of about 15 minutes between the time the man began to lead officers away from the vehicle and the time of the police shooting.Lonnie Sweet, a trucker who witnessed the event, said, “He wouldn’t take the gun from his head. He just kept walking away from them. The cops kept following him. Eventually, he walked into the Amazon parking lot there. It was out of our sight. Next thing you know, you heard four or five shots go off.”Body camera video released Tuesday shows the suspect, later identified as 35-year-old Michael Simpson from Cleves, leading officers toward the Amazon facility. The video shows Simpson with a gun to his head and about five officers following him with guns pointed at him, telling him to drop the weapon. This continues for several minutes, with Simpson saying he did not want to be arrested or go back to jail, and that he wanted his phone charged to call a woman named “Bree” who Sanders believes is his girlfriend.Body camera video shows that at one point, Simpson starts walking toward officers with the gun in his hand. That’s when two deputies fired four shots, hitting Simpson.Officials attempted lifesaving measures, but Simpson was pronounced dead at the scene. The two deputies, TJ Shinkle and Daniel Walker, fired the shots. Shinkle fired three shots, and Walker fired one.Sanders said Walker was actually off duty and was headed home when they heard the call and responded. Sanders said neither deputy had their body camera activated but they were able to utilize other deputies’ body cameras who also responded to show what transpired. Sanders said he believes the officers were in reasonable fear they were about to suffer death when they fired their weapons, saying he does not expect officers to wait until they are fired upon to make that decision. He said the situation was too dangerous for the public for officers to retreat and too dangerous for officers to be hands-on with the armed suspect, and the use of lethal force was the one realistic option in this case.Sanders said the case will not be presented to the grand jury, and the investigation is now considered closed. Two officers have been cleared of any wrongdoing after a fatal police shooting near an Amazon facility in Florence last month.
Kenton County Commonwealth’s Attorney Rob Sanders said the two officers were justified in their use of deadly force.
“This was just an unfortunate and tragic situation of a suspect attempting to commit suicide by cop,” Sanders said.
The incident began just before 7 a.m. April 29 on Industrial Road with a report of a stolen tractor trailer, and ended with shots fired outside the Amazon facility.
It all started when police said officers pulled a man over. They said when the man stopped, he was not compliant with commands, which resulted in a “physical altercation.”
Witnesses said the man exited the vehicle with a gun and pointed it at his own head, leading officers to follow him as he walked toward the Amazon facility.
